TACLOBAN CITY – The members of the Sangguniang Panlalawigan passed a resolution favoring to the sand and gravel-industrial permit (SAG-IP) application of Engr. Francis Lloyd Chua, operations manager of MAC Builders.
The SAG-IP operations of MAC Builders intends to operate along the river bed of Daguitan River located along Barangay Bonifacio and Tagkip in the municipality of Julita.
The members of provincial board approved the resolution to the sand and gravel permit of Engr. Chua after the members of the committee on environment and natural resources headed by Board Member Roque Tiu through a committee report in their last session reported that the company was able to comply with all the necessary requirements needed for their operation.
Among these requirements are the resolution interposing no objection in the lower level Sanggunians (barangay and municipal) pursuant to Sections 26 and 27 of the Local Government Code of the Philippines and Article V, Section 21 of the Environmental Code of the Province of Leyte.
The Mines and Geosciences Bureau in the region also issued a favorable recommendation to the application dated October 14, 2011 stating that among other applicants they were able to comply with the documentary requirements and the applied area is located outside the one kilometer radius prohibited zone as defined by law particularly the Philippine Mining Act of 1995.
However, said resolution can be revoked or retracted following violations or the circumstances becoming apparent, according to Tiu.
These violation includes, non-payment of any taxes, fee and permits accruing to the LGU concerned as well as to the national government; extraction of sand and gravel beyond the permit area; violation of the terms and conditions set forth in the ISAG permit issued by MGB-RO8; violation of the provisions of the Environmental Code of the Province of Leyte; Employment of minors by the permittee during its operations; unfair labor practices extraction using explosives that may imperil human beings; and activities that will be hazardous to the community and the environment.
